Welcome to ArtExtract.ai (“ArtExtract,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the ArtExtract.ai website, application, and services (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

ArtExtract.ai provides AI-powered tools that allow users to:

  • Extract artwork from photos of printed products

  • Convert raster images (e.g., PNG, JPEG, WebP) into scalable vector files

  • Export processed files in supported formats (such as SVG and PNG)

The Service is intended for the processing, transformation, and preparation of user-submitted artwork and images into digital output files for production and related commercial or professional use.

2. Eligibility

You must be at least 18 years old to use the Service. By using ArtExtract.ai, you represent that you have the legal capacity to enter into this agreement.

3. User Accounts

To access certain features, you must create an account.

You agree to:

  • Provide accurate information

  • Maintain the security of your login credentials

  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content & Intellectual Property

Ownership

You retain ownership of any artwork, images, or files you upload (“User Content”).

We do not claim ownership of your uploaded files.

Responsibility

You are solely responsible for ensuring that:

  • You own the rights to the artwork you upload, or

  • You have permission from the rightful owner to process it

You agree not to upload:

  • Copyrighted material without authorization

  • Trademarked logos without permission

  • Illegal, infringing, or unlawful content

ArtExtract.ai does not verify ownership of uploaded content and is not responsible for copyright violations committed by users.

5. License to Operate the Service

By uploading content, you grant ArtExtract.ai a limited, non-exclusive license to process, analyze, and transform your content solely for the purpose of providing the Service.

We do not sell, publish, or publicly display your uploaded artwork.

6. Credits, Billing & Subscriptions

ArtExtract.ai operates on a credit-based system.

  • Extraction (photo → artwork extraction → vector file) consumes 29 credits.

  • Vectorization (raster image → vector file) consumes 9 credits.

  • Credits are allocated based on your subscription plan.

Credits:

  • Refresh each billing cycle

  • Do not roll over

  • Have no cash value

Subscription fees are billed in advance on a recurring basis. You may cancel at any time. Access continues through the end of the billing period.

Refunds are governed by our Refund Policy.

7. Output & Accuracy Disclaimer

While ArtExtract.ai is designed to generate production-ready files, results may vary depending on input image quality, complexity of artwork, and the presence of gradients or photorealistic elements.

You are responsible for reviewing all generated files before production. We do not guarantee that output files will be error-free, perfectly color-separated, or ready for immediate use without review.

8. Acceptable Use

You agree not to:

  • Use the Service for illegal purposes

  • Upload harmful, abusive, or unlawful content

  • Attempt to reverse-engineer or exploit the system

  • Abuse credit usage through automated scraping or misuse

We reserve the right to suspend accounts that violate acceptable use standards.

9. Data & Privacy

Your use of the Service is also governed by our Privacy Policy.

Uploaded files are processed to generate output. We implement reasonable security measures to protect user data.

We do not publicly share uploaded artwork.

10. Termination

We may suspend or terminate access to the Service if:

  • You violate these Terms

  • You misuse the platform

  • Required by law

You may stop using the Service at any time.

Termination does not entitle you to refunds unless stated in the Refund Policy.

11. Limitation of Liability

To the maximum extent permitted by law:

ArtExtract.ai shall not be liable for:

  • Production errors resulting from file usage

  • Loss of profits

  • Business interruption

  • Indirect, incidental, or consequential damages

The Service is provided “as is” without warranties of any kind. Your use of generated files in production is at your own risk.

12. Indemnification

You agree to indemnify and hold harmless ArtExtract.ai from any claims arising from your uploaded content, intellectual property violations, or misuse of the Service.

13. Modifications

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of updated Terms.

14. Governing Law

These Terms shall be governed by the laws of the United States, without regard to conflict of law principles.
